lavoratore astenersi temporaneamente dalla propria prestazione lavorativa
quando non vi siano le condizioni di tutela relative alla salute e sicurezza
sul lavoro, in quanto l’ambiente lavorativo risulta oggettivamente
pericoloso.</P>

i giudici della Suprema Corte hanno affermato la garanzia, in capo al
lavoratore, della retribuzione anche relativamente al periodo di “non lavoro”
dovuto proprio alla sospensione dell’attività lavorativa per i motivi
suindicati, in quanto il rifiuto del lavoratore, nel caso specifico, non può
costituire un inadempimento contrattuale, in quanto determinato da un
inadempimento del datore di lavoro agli obblighi di sicurezza previsti
dall’art. 2087
