di cui 61 operai, dislocati nei 2 reparti produttivi, il primo per la
preparazione del semilavorato denominato nastri-forni e<SPAN class=GramE><SPAN
style="mso-spacerun: yes"> </SPAN></SPAN>il secondo per la produzione di
cuscinetti finiti denominato <SPAN class=SpellE>automatiche-ripresa</SPAN>
composto anche da un’area per la stagnatura e la cernita.</SPAN></P>

alla richiesta anticipata di CIGS a partire dal 01/01/2010 per 12 mesi per 48
dipendenti, mentre si poteva utilizzare altre 13 settimane di CIGO spettanti
ai lavoratori.</SPAN></FONT></SPAN></P>

CIGO, vi è stato <SPAN class=SpellE><SPAN
class=GramE>un’utilizzo</SPAN></SPAN><SPAN class=GramE> massiccio</SPAN> di
ore di lavoro straordinario, che andava ben oltre la normale e regolare
attività di produzione rispetto all’organico in
forza.</SPAN></FONT></SPAN></P>
<P class=MsoNormal><SPAN style="mso-bookmark: DDE_LINK"><SPAN
class=GramE><FONT size=3 face="DejaVu Sans"><SPAN
style="FONT-SIZE: 12pt">Infatti</SPAN></FONT></SPAN> la maggior parte dei
lavoratori, ha sempre fatto tantissime ore di straordinario, che spesso non
sono mai state registrate nelle timbrature: si arrivava alle 6.00 di mattino,
si usciva alle 17.00, ma la timbratura era eseguita, come un turno normale,
cioè uscita alle 14,00. Questo anche il sabato e la domenica. </SPAN></P>
<P class=MsoNormal><SPAN style="mso-bookmark: DDE_LINK"><FONT size=1
face="DejaVu Sans"><SPAN
style="FONT-SIZE: 8pt"><o:p> </o:p></SPAN></FONT></SPAN></P>

tutti i dati sui quali si vuol fare riferimento, sia per la richiesta di <SPAN
class=SpellE>Cigo</SPAN>: “<SPAN class=GramE>una</SPAN> parziale riduzione
degli ordini” e sia per la richiesta di CIGS: “per crisi aziendale per evento
improvviso ed imprevisto”,<SPAN style="mso-spacerun: yes"> </SPAN>tra
l’altro l’azienda parla di un<SPAN style="mso-spacerun: yes">
</SPAN>presunto calo del 32% di produzione ma non ha mai fornito dati e
documentazione in merito.</SPAN></FONT></SPAN></P>
<P class=MsoNormal><SPAN style="mso-bookmark: DDE_LINK"><FONT size=1

ingresso è la scelta dell’azienda di comprare <B

cuscinetti a <SPAN class=SpellE>strisciamento</SPAN> già finiti e pronti per
essere commercializzati</SPAN></B>, al posto del prodotto che avremmo come di
solito dovuto costruire . Questa operazione <SPAN class=GramE>e'</SPAN>
cominciata <SPAN class=SpellE>gia'</SPAN> nel Dicembre del 2007.</SPAN></P>
<P class=MsoNormal><SPAN style="mso-bookmark: DDE_LINK"><FONT size=3
face="DejaVu Sans"><SPAN style="FONT-SIZE: 12pt">Con l'andare del <SPAN
class=GramE>tempo l'</SPAN>immissione di questo materiale e' aumentata<SPAN
style="mso-spacerun: yes"> </SPAN>inversamente proporzionale alla
materia prima che veniva a mancare per <SPAN
style="mso-spacerun: yes"> </SPAN>arrivare al 70% della produzione.<SPAN

</SPAN>Questa operazione sarebbe verificabile confrontando la fatturazione
emessa, con gli<SPAN class=GramE><SPAN style="mso-spacerun: yes">
</SPAN></SPAN>ordini relativi alla realizzazione e relativa filiera di
controllo della documentazione <SPAN class=SpellE>qualita'</SPAN> ISO e le
fatture del materiale in ingresso.<SPAN

dell'avvento della crisi internazionale, in particolare il reparto di ripresa,
aveva avuto già prima una riorganizzazione con automatizzazione e riduzione di
personale. In questo reparto nel 2007 sono state acquistate 3 macchine
automatiche: 2 <SPAN class=SpellE>Omas</SPAN> (a004 e a005) e 1 Pg1 (a006) che
coprono tutta la gamma di prodotto finito da d65mm a d240mm, e prima
dell’apertura della <SPAN class=SpellE>Cigo</SPAN> gli operai in eccesso sono
stati spostati momentaneamente <SPAN class=GramE>alla </SPAN><SPAN
class=SpellE>Hymon</SPAN> (fabbrica vicina dello stesso gruppo) o in un
capannone di deposito del materiale finito comprato da fornitori esterni, dove
veniva <SPAN class=GramE>confezionato</SPAN>, lavato e marchiato <SPAN
class=SpellE>Technymon</SPAN>, mentre alcuni sono statiti in America<SPAN
style="mso-spacerun: yes"> </SPAN>nella sede di Chicago.
</SPAN></FONT></SPAN></P>
<P style="mso-pagination: lines-together" class=MsoNormal><SPAN
style="mso-bookmark: DDE_LINK"><FONT size=3 face="DejaVu Sans"><SPAN
style="FONT-SIZE: 12pt">Questa operazione non centrava nulla col periodo di
crisi mondiale che ora <SPAN class=GramE>viene</SPAN> preso a pretesto per il
ridimensionamento definitivo di una produzione (ripresa) ritenuta dall’azienda
vecchia e non più concorrenziale e per eliminare definitivamente gli
operai.</SPAN></FONT></SPAN></P>

class=SpellE>Cigs</SPAN>, per fare della pulizia antisindacale del personale
scomodo, utilizzando la “crisi” che alla <SPAN
class=SpellE>Technymon</SPAN><SPAN class=GramE><SPAN
style="mso-spacerun: yes"> </SPAN></SPAN>non ha la dimensione e la <SPAN
class=SpellE>gravita'</SPAN> che le si vuole addebitare e che per raggiungere
questi obbiettivi ci sono state irregolarità nei rinnovi di <SPAN
class=SpellE>cigo</SPAN> e nella <SPAN
class=SpellE>cigs</SPAN>.<o:p></o:p></SPAN></FONT></B></SPAN></P>

furono sospesi a zero ore 90 lavoratori su 94. L’attività aziendale doveva
pertanto ritenersi sospesa <SPAN class=SpellE>pressochè</SPAN> completamente.
In realtà nel corso del periodo numerosi lavoratori sono stati chiamati a
svolgere il proprio lavoro presso <SPAN class=SpellE>Technymon</SPAN> come ad
esempio i signori Ferdinando <SPAN class=SpellE>Toti</SPAN>, Cinesi Villi,
<SPAN class=SpellE>Cordun</SPAN> <SPAN class=SpellE>Petru</SPAN><SPAN
class=GramE> ,</SPAN> <SPAN class=SpellE>Baglioni</SPAN> Francesco, <SPAN

dipendenti su 93. L’accordo prevedeva la rotazione del personale. I dipendenti
che non hanno <SPAN class=GramE>effettuato</SPAN> rotazione sono soltanto 7 su
94 e ciò denota una condotta<SPAN

</SPAN>discriminatoria dell’azienda nei confronti di costoro.

specificano i criteri di scelta dei lavoratori da porre in cassa o, se del
caso, i motivi impeditivi alla rotazione. Ciò determina illegittimità della
sospensione in cassa integrazione dei lavoratori. <SPAN
class=GramE>Inoltre</SPAN>, nonostante l’accordo prevedesse rotazione, questi
non l’hanno mai svolta nonostante la fungibilità delle loro
mansioni.<o:p></o:p></SPAN></SPAN></FONT></SPAN></P>

sulla CIGS è illegittimo in quanto non è stata fornita l’informativa ex art. 5
legge 164/1975 e, in particolare, è stata omessa l’indicazione (ex art.
<st1:metricconverter w:st="on" ProductID="1 C">1 C</st1:metricconverter><SPAN
class=SpellE>.7</SPAN> e 8 legge 223/91) dei criteri di scelta dei lavoratori
da sospendere e le eventuali ragioni <SPAN class=GramE>impedienti la</SPAN>
rotazione per alcuni lavoratori. Al riguardo <SPAN class=GramE>le</SPAN>
generiche frasi di circostanza riportate nell’accordo non consentono di
esaminare compiutamente la dedotta crisi aziendale, non essendo accompagnate
da alcuna specificazione, documenti allegati e dati di bilancio. La causa
integrabile si riduce <SPAN class=GramE>a ad</SPAN> una stereotipata <SPAN
class=SpellE>formuletta</SPAN> che i lavoratori non possono contestare. Si
contesta, ancora una volta, la mancata rotazione dei lavoratori e la
fungibilità delle loro mansioni con i lavoratori in attività. Si contesta
anche che la sospensione in cassa a zero ore riguardi 48 dipendenti su 94 come
denotano le fotografie allegate che raffigurano il parcheggio aziendale
(dicembre 2009) pieno delle auto dei dipendenti.
